Contracting Party
On the basis of these General Terms and Conditions (GTC), a contract is concluded between the customer and BADESOFA® Interior Design GmbH, represented by:
Natalie Steger and Annika Götz
Address: Friesenstraße 50, 50670 Cologne
hereinafter referred to as the provider.
Subject Matter of the Contract
This contract regulates the sale of new goods in the field of bathroom accessories via the provider’s online shop. Details of the respective offers can be found in the product description on the offer page.
Conclusion of Contract
The contract is concluded exclusively in electronic commerce via the shop system. The displayed offers represent a non-binding invitation to submit an offer by placing an order, which the provider may then accept.
The order process for concluding the contract includes the following steps:
- Selection of the product in the desired specification (size, color, quantity)
- Placement of the product in the shopping cart
- Clicking the button “Checkout”
- Entering billing and delivery address
- Selection of the payment method
- Review and, if necessary, correction of all order details
- Clicking the button “Buy”
- Confirmation email that the order has been received
The contract is concluded when the order confirmation is sent.
For deliveries to Switzerland, the purchase contract is concluded between the buyer and MeinEinkauf AG, St. Gallen (CHE-331.561.017 VAT). This company also handles customs clearance, invoicing, and delivery in Switzerland. This service is included in the purchase price and any shipping costs. To ensure smooth delivery, MeinEinkauf GmbH in Constance, Germany (DE285677365) is also involved in the supply chain. No additional costs are incurred for the buyer.
Duration of the Contract
The contract is concluded for an indefinite period.
Retention of Title
Until full payment has been made, the delivered goods remain the property of the provider.
The provider reserves the right not to provide the promised service in the event of non-availability.
Prices, Shipping Costs, Return Costs
All prices within the EU are final prices and include statutory VAT.
Please note that outside the EU, additional customs duties and VAT may apply, which must be borne by the customer.
If a right of withdrawal exists and is exercised, the customer bears the costs of the return.
Shipping costs are indicated in the online shop. The total price including VAT and shipping costs is also shown in the order form before you submit your order.
Payment Conditions
The customer has the following payment options: Credit card (Mastercard, VISA), Maestro, PayPal, Apple Pay, Shop Pay, Google Pay, Bancontact, iDEAL, Klarna, eps transfer.
Other payment methods are not offered and will be rejected.
The customer has no right of retention that is not based on the same contractual relationship.
Set-off with customer claims is excluded unless these are undisputed or have been legally established.
Delivery Conditions
The delivery period varies depending on the product and is specified on the respective product page. We endeavor to provide accurate and up-to-date information regarding delivery times. The delivery times stated are non-binding and may change. Any changes to delivery times will be communicated to you during the ordering process. Please note that individual circumstances such as product availability, customizations, or personalized orders may affect delivery times.
If the provider is unable to deliver permanently due to force majeure or non-delivery by its own supplier (despite timely procurement of cover transactions), the provider is entitled to withdraw from the contract. The customer will be informed immediately, and payments already made will be refunded.
Right of Withdrawal and Customer Service
Right of Withdrawal
You have the right to withdraw from this contract within 30 days without giving any reason. The withdrawal period is 30 days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us (BADESOFA® Interior Design GmbH, Brüsseler Str. 89–93, 50672 Cologne, Tel.: 0221/17074574, returns@badesofa.de, by means of a clear declaration (e.g. a letter sent by post, fax, or email).
You can also complete and submit the sample withdrawal form or another clear statement electronically to hello@badesofa.de. If you use this option, we will immediately send you confirmation (by email) of receipt of such a withdrawal. To comply with the withdrawal period, it is sufficient to send your notification before the period of 30 days has expired.
Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments received from you immediately and at the latest within 30 days from the day we receive notification of your withdrawal. For this refund, we will use the same payment method that you used in the original transaction unless expressly agreed otherwise. Under no circumstances will you be charged fees for the refund.
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return the goods immediately and in any event no later than fourteen days from the day on which you informed us of the withdrawal.
The deadline is met if you send the goods before the 30-day period has expired. The costs for the return are borne by us. On our returns page you will find the corresponding links for the return labels. We reserve the right to change this regulation at any time and no longer cover return costs.
You are only liable for any diminished value of the goods if this is due to handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

We usually respond within 48 hours, but no later than within five working days.
Return of Set Offers (Multi-Item Product Sets)
For special set offers where multiple products are sold together at a discounted total price (“set price”), the price advantage applies only when the entire set is purchased and kept.
Partial returns of individual set components are not permitted.
If the customer nevertheless returns part of a set, the set discount will be fully recalculated. In this case, the price of the product retained by the customer will be adjusted to the regular single-item price without the set discount.
The refund amount is calculated as follows:
Refund = paid set price – regular single-item price of the product retained by the customer.
The customer is not entitled to retain any portion of the set discount if individual set items are kept.
Warranty
Consumers are entitled to statutory warranty rights under the relevant provisions of the German Civil Code (BGB). If deviations are made, the warranty is governed by the provisions in these General Terms and Conditions.
The provider is entitled, in the case of subsequent performance, to choose between repair or replacement if the goods are new and the customer is an entrepreneur.
This does not apply to claims for damages by the customer due to injury to life, body, or health or to essential contractual obligations, nor to claims for damages based on gross negligence or intentional breach of duty by the provider or its legal representatives or agents. In all other respects, the statutory provisions apply.
Contractual Design
If the customer is an entrepreneur, the risk of accidental loss or deterioration of the goods passes to the customer upon delivery or, in the case of shipment, upon handover to the selected service provider.
The provider stores the contract text.
The customer can access the stored contract text as follows: If you have created an account, you can view your orders under "Orders" in your account at www.badesofa.de.
Exclusion of Liability
Claims for damages by the customer are excluded unless otherwise stated for the following reasons. This also applies to representatives and vicarious agents of the provider. Excluded are claims for damages due to injury to life, body, or health or for the fulfillment of essential contractual obligations, as well as claims for damages based on gross negligence or intentional breach of duty.
Prohibition of Assignment and Pledging
The customer’s claims or rights against the provider may not be assigned or pledged without the provider’s consent, unless the customer can prove a legitimate interest in the assignment or pledge.
Language, place of jurisdiction, and applicable law. The contract is drawn up in German. Further performance of the contractual relationship will also take place in German. The law of the Federal Republic of Germany shall apply exclusively. For consumers, this applies only insofar as no mandatory provisions of the state in which the customer has their residence or habitual abode are restricted.
The place of jurisdiction for disputes with customers who are not consumers, legal entities under public law, or special funds under public law shall be the registered office of the provider.
BADESOFA® Gift Vouchers
(1)General: BADESOFA® gift vouchers are vouchers that you can purchase. By purchasing a BADESOFA® gift voucher, you accept the General Terms and Conditions. Gift vouchers can only be purchased and redeemed in the BADESOFA® webshop (badesofa.de). The voucher can be used to pay for the total or partial value of the selected items. If the balance is insufficient, the difference can be paid with the available payment methods. Our customer service is happy to assist you with questions regarding remaining balances.
(2) Delivery: When ordering a gift voucher, you are obliged to provide a correct email address for delivery. You will receive your gift voucher by email. If the email address cannot be confirmed, BADESOFA® reserves the right to withhold delivery of the gift voucher.
(3) Redemption: Gift vouchers can only be redeemed before completing the order process. The balance will not be paid out in cash and does not accrue interest.
(4) Validity: The gift voucher is valid for 3 years from the date of purchase. After expiration, it cannot be used, reactivated, or refunded. The voucher can be used within the 3-year period until the balance is zero. Gift vouchers can only be redeemed in the currency in which they were purchased.
(5) Exchange: Gift vouchers are excluded from exchange.
(6) Refunds: If you exercise your right of withdrawal for items purchased with a gift voucher, the refunded amount will first be credited back to the gift voucher before other payment methods are refunded. See “Right of Withdrawal” for details.
Severability Clause
The invalidity of any provision of these GTC shall not affect the validity of the other provisions.
